‘Warning Shot’ Fired After Driver Allegedly Ran Victim Off Road During Sunrise Road Rage

A Miami man is facing felony charges after Sunrise police say he fired a “warning shot” during a road rage incident that allegedly forced another driver off the road and onto a median.

According to a Sunrise Police Department arrest report, Patrick Joseph, 36, was arrested on July 27 and charged with aggravated assault with a deadly weapon without intent to kill and discharging a firearm from a vehicle.

According to a probable cause affidavit, the incident occurred in the afternoon near South New River Circle and Weston Road. Officers first became aware of the gunshots in traffic after the victim called 911 to report that someone in a gray Mercedes van had fired a shot at his vehicle.

The victim told dispatchers he continued following the van until it stopped near 2550 Glades Circle in Weston, where Broward Sheriff’s Office deputies responded.

Deputies located the Mercedes van, detained Joseph, and recovered a silver gun from above the driver’s side sun visor, according to investigators.

The victim told detectives he was traveling north on Weston Road when Joseph allegedly pulled onto the roadway from South New River Circle and got close to his vehicle, forcing him onto the center median. While both vehicles were still moving, the victim said Joseph rolled down his window, pointed a silver handgun at him and fired a shot before continuing northbound.

The victim continued following the van through Weston until law enforcement arrived. Joseph agreed to speak with officers. According to the affidavit, he said he had just completed a delivery at a Chase Bank and was attempting to pull onto Weston Road when the victim’s vehicle struck his driver’s side mirror.

Joseph claimed the two drivers lowered their windows and that the victim yelled a racial slur while reaching toward the front passenger seat. Joseph told investigators he had previously been shot during another road rage incident and believed the victim was about to shoot him.

Fearing for his safety, Joseph admitted grabbing his .38-caliber revolver and firing what he described as a “warning shot” toward the rear of the victim’s vehicle.

Joseph was arrested and transported to the Broward County Main Jail.
